TERMS OF SERVICE FOR CUSTOMERS

Welcome to BookMe.Beauty (the "Platform"), operated by BookMe.Beauty LLC ("Company", "we", "us"). By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

1. Overview & Acceptance

BookMe.Beauty is a technology platform that connects Customers with independent beauty professionals ("Professionals": stylists, nail technicians, salons). We are not a provider of beauty services. All services are performed solely by independent third-party Professionals. We may, but do not guarantee that we will, verify Professionals' licenses or credentials; you are responsible for evaluating any Professional before booking.

2. Eligibility & Accounts

• You must be at least 18 years old to use the Platform.

• You are responsible for maintaining the confidentiality of your account and password.

• You agree to provide accurate and complete information.

• We may suspend or terminate accounts for violations.

3. Bookings & Payments

• Every booking is a direct contract between you (Customer) and the Professional.

• Payments are processed via Stripe. BookMe.Beauty collects a platform fee, displayed before booking.

• Cancellation, no-show, and refund policies are set by each Professional and displayed before booking. You may be charged for late cancellation or no-show according to the Professional's policy.

• Platform fees are non-refundable. Service refunds depend on the Professional's policy.

• Tips are voluntary and go directly to the Professional.

4. User Conduct & Content

You agree not to:

• Post false, defamatory, or illegal content.

• Harass, threaten, or discriminate against other users.

• Attempt to circumvent our payment system.

• Use the Platform for any illegal purpose.

All user-generated content (reviews, chat, uploaded photos) must comply with our Community Guidelines.

5. Intellectual Property

• The Platform and all its content (logos, design, software) are owned by BookMe.Beauty LLC.

• You grant us a worldwide, non-exclusive, royalty-free license to use your content (photos, reviews) for operating and promoting the Platform.

6. AI Try-On

The AI Try-On feature allows you to upload a photo to generate a simulated preview of how a hairstyle or beauty look may appear on you. This feature is entirely photo-based — it does not use your device camera in real time and does not involve augmented reality (AR).

Photos uploaded for AI Try-On are processed by third-party AI providers (e.g., OpenAI) solely to generate preview images. We do not claim ownership of your photos. AI-generated previews are simulations for reference only and do not represent or guarantee the actual outcome of any service. Differences between a preview and actual results do not constitute grounds for refunds or claims against BookMe.Beauty.

6A. Copyright Complaints (DMCA)

If you believe content on the Platform infringes your copyright, send a notice compliant with the Digital Millennium Copyright Act to legal@bookme.beauty including: identification of the work, the infringing material's location, your contact information, a good-faith statement, and your signature. We will remove infringing content and may terminate repeat infringers.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKME.BEAUTY IS NOT LIABLE FOR:

• Any acts or omissions of independent beauty Professionals.

• The quality, safety, or outcome of any beauty services.

• Any damages, injuries, or losses resulting from bookings.

• Indirect, incidental, consequential, or punitive damages.

Our total liability shall not exceed the platform fees you paid in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold BookMe.Beauty harmless from any claims, damages, or liabilities arising from your use of the Platform, your interactions or disputes with other users, or your violation of these Terms.

9. Dispute Resolution

• Before initiating arbitration, you must send a written notice of dispute to legal@bookme.beauty, and both parties shall attempt informal resolution for thirty (30) days.

• If unresolved, disputes shall be resolved by binding arbitration in Delaware, USA, under the rules of the American Arbitration Association.

• You waive the right to participate in class action lawsuits.

• Opt-out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@bookme.beauty with your name and account email.

10. Termination

We may terminate or suspend your account at any time for violations. You may terminate your account at any time.

11. Governing Law & Severability

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

12. Changes & Contact

We may update these Terms; continued use after changes constitutes acceptance.
